• Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas of the Service.
• Use any automated means (including bots, scrapers, or spiders) to access or use the Service for any purpose without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.

5. User Content

5.1. Your Content

You retain ownership of any intellectual property rights in the content, ideas, or business models you submit or create using the Service ("User Content"). By submitting User Content, you grant VibeStartup.pro a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and improving the Service.

• You are solely responsible for your User Content and the consequences of posting or publishing it.
• You represent and warrant that you have all necessary rights to submit your User Content and that it does not infringe or violate any third-party rights.

5.2. AI-Generated Content

Content generated by our AI systems based on your inputs ("AI-Generated Content") is provided to you under the following terms:

• You receive a worldwide, non-exclusive, royalty-free license to use, modify, and commercialize the AI-Generated Content as part of your startup or business.
• VibeStartup.pro retains the right to use anonymized data, patterns, and learnings derived from your use of the Service to improve our products and services.
• VibeStartup.pro does not claim ownership of your finished startup product that incorporates AI-Generated Content.
• You are responsible for reviewing and vetting AI-Generated Content for accuracy, legality, and suitability for your intended use.

5.3. Our Content

The Service and its original content (excluding User Content and AI-Generated Content provided to users), features, and functionality are owned by VibeStartup.pro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use, copy, modify, or distribute our content without our express written permission.

6. Subscription, Payment, and Refunds

• Certain features of the Service may require payment of fees. By selecting a paid plan, you agree to pay all applicable fees as described at the time of purchase.
• Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).
• You authorize us to charge your chosen payment method for all subscription fees and any applicable taxes.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of the current billing period.
• Refunds are provided in accordance with our Refund Policy.
• We reserve the right to change our pricing and subscription plans at any time. We will provide notice of any material changes.

7. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security.

8. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by VibeStartup.pro. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk.

9. Termination

• We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
• Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. VibeStartup.pro makes no warranties, express or implied, regarding the Service, including but not limited to:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results that may be obtained from the use of the Service will be accurate, reliable, or suitable for your purposes.
• The quality of any information, content, or other material obtained through the Service will meet your expectations.
• AI-Generated Content will be free from errors, biases, or other issues.
• Your startup or business will be successful in the marketplace.

You acknowledge that AI-Generated Content may contain inaccuracies, errors, or biases, and you are solely responsible for verifying its accuracy and appropriateness for your use.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall VibeStartup.pro, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• The quality, accuracy, or reliability of AI-Generated Content.
• Unauthorized access, use, or alteration of your transmissions or content.
• Business decisions made based on the use of our Service.

Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid, if any, for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless VibeStartup.pro and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your use of the Service or AI-Generated Content has caused damage to a third party.

13. Export Compliance

You may not use, export, or re-export the Service except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. You represent and warrant that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country and are not listed on any U.S. government list of prohibited or restricted parties.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes through the Service or via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

16. Miscellaneous

• These Terms constitute the entire agreement between you and VibeStartup.pro regarding your use of the Service and supersede all prior agreements.
• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
• You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
